Taking Possession
 

The ideal scenario is to have the closing date and possession of the home on the same day. The ideal scenario is to receive the keys to a clean, vacant house on closing day.

The standard procedure is that your loan must fund before you receive the keys. Usually the loan funding takes a few hours after all documents have been signed. This normally gets done on the same day as signing. However, if your closing is late in the day, it may not fund until the next day. If possible, allow one day grace period before your moving van arrives at your new home.

 
Pre and Post Sale Leases

In some cases, a buyer's pre-lease can be used to give you possession before closing. Or, you may agree to allow the seller to stay in the property for a short time after closing. The Buyer's Pre-Lease or Seller's Lease-Back lease must be agreed upon at the same time your offer is negotiated. .

We prefer that buyers and sellers avoid pre and post sale leases, unless absolutely necessary. This may open the door to disputes about the condition of the house. Unlike regular leases, this lease obligates the "tenant" to pay for all repairs and maintenance. This means that if the AC compressor breaks down before closing (while you are in the house under a buyer's lease), the seller is not obligated to repair it. It is best to move into your home after you have ownership.
